Terms of service

Last updated: September 10, 2026

These terms cover two things: using this website, and hiring WinterBrooke Media to build yours. They're written in plain English on purpose. The signed proposal you receive for a project controls if it ever conflicts with this page.

1. Who these terms are between

"We," "us," and "WinterBrooke Media" mean [LEGAL ENTITY NAME, e.g. "Sip Happens Mobile LLC d/b/a WinterBrooke Media"], Orlando, Florida. "You" means the person or business using this Site or hiring us.

2. Using this website

You can browse the Site and use the quote form for their intended purpose. You agree not to scrape it, attack it, submit false information, or use it to send spam. The content, wordmark, and design of the Site belong to us and may not be copied without permission — except the "hostage contract" cards, which you're welcome to share.

3. Quotes

Submitting the form isn't a contract; it's a request for a price. We reply with a written quote and proposed launch date. A project starts when you approve the quote in writing (email is fine) and pay the deposit. Quotes are valid for 30 days.

4. Pricing and payment

5. What you own

This is the important one. On receipt of final payment, you own the website: the code, the design, the written content we created for you, and every account it runs on. Specifically:

Until final payment, the work-in-progress is ours. If a project is cancelled before launch, the deposit is non-refundable and covers the work completed to that point.

6. Timelines and what we need from you

Quoted launch dates assume you send photos, business details, and feedback within a few days of each request. If your side takes longer, the launch date moves by the same amount. Projects with no response from you for 30 days may be paused and restarted for a scheduling fee stated in your quote.

7. Revisions

Each plan includes two rounds of revisions during the build. A "round" is one consolidated set of feedback. Additional rounds, or changes after launch that aren't covered by the Care Plan, are billed at the hourly rate in your quote.

8. Care Plan

The Care Plan covers hosting management, backups, software and security updates, uptime monitoring, and up to one hour per month of content edits. Unused hours don't roll over. It doesn't cover redesigns, new pages, or new features, which we quote separately. You can cancel by email any time. If you cancel, your site stays live on your own hosting; you're simply responsible for it from then on.

9. Search rankings, results, and what we don't promise

We build sites the way search engines want and set up your Google Business Profile properly. We do not and cannot guarantee a specific ranking, traffic number, or amount of business. Anyone who does is guessing. We also can't guarantee results that depend on third parties (Google, hosting providers, form services) staying the same.

10. Your content and conduct

You're responsible for the accuracy and legality of the information on your site (licenses, insurance claims, pricing, reviews). We won't build anything that's unlawful, defamatory, or misleading, and we can end a project and refund unearned fees if we're asked to.

11. Warranty and liability

We'll fix any defect in our work reported within 30 days of launch at no charge. Beyond that, the site is provided as-is. To the fullest extent Florida law allows, our total liability for any claim related to a project or this Site is limited to the amount you paid us for that project in the 12 months before the claim, and we're not liable for indirect, incidental, or consequential damages (like lost revenue) even if we were told they were possible.

12. Ending the relationship

Either of us can end a project with written notice. You pay for work completed to that date; we hand over what's been built to that point once that's paid. Sections 5, 9, 11, and 13 survive.

13. Governing law and disputes

These terms are governed by the laws of the State of Florida. Before either of us files anything, we agree to try to work it out directly for 30 days. If that fails, disputes go to the state or federal courts located in Orange County, Florida, and each of us consents to that venue.

14. Changes to these terms

We may update these terms; the date at the top will change. Projects already under way stay on the terms in their written quote.
